This Refund Policy explains refunds and cancellations for paid access to Breakflare (the "Service") offered by Bond Solutions, s.r.o., a company registered in the Slovak Republic ("Breakflare," "we," "us," or "our"). It applies to
purchases made through https://app.breakflare.com and pricing pages linked from https://www.breakflare.com.
Read it with our Terms of Service. If this policy and the Terms conflict, the Terms control,
except where consumer law requires a refund this policy would not pay.
A consumer is a person who buys mainly for personal use, outside their trade,
business, craft, or profession. The country entries below are for consumers. A purchase made for a business, and an
Enterprise agreement, has no change-of-mind refund. If you bought Enterprise as a consumer and an entry below still
applies to you, that entry controls.
Use the entry for the country where you normally live. Our seat in the Slovak Republic does not remove a mandatory
right in your country, and it does not create a refund right your country does not give you. The periods are the
statutory windows we honor as of 2 November 2026. If a mandatory rule gives you a refund this page does not
list, that rule still applies and we will follow it.
1. What you pay
Paid access today is:
- Core (free, no card): daily shortlist (excluding top 3), watchlist,
email and Telegram alerts, 1 portfolio tracker, 90 days of pick history, and the spot trading agent.
- Plus ($200/month or $2,000/year): named top 3 and the full shortlist, live
terminal charts, whales, unlimited trackers, email and Telegram alerts, and 90 days of pick history. Yearly is 2
months free versus monthly.
- Enterprise (custom pricing): desk, team, and API terms agreed separately.
- Agent credits: optional pay-as-you-go top-ups, and optional auto-recharge, that
fund live usage of Breakflare trading agent. Paper mode never debits credits.
Plus monthly and yearly plans renew automatically until you cancel. Core is free and does not renew.
Prices are in USD at checkout unless stated otherwise. Taxes may be added based on your location. A statutory refund
includes the tax we collected on the refunded charge.
2. Change-of-mind refunds the law requires
These are cooling-off and withdrawal rights: you may change your mind without giving a reason. A credit top-up or
auto-recharge is its own purchase, and its period starts on the day of that charge. For the European Union, the EEA,
and the United Kingdom, the 14 days run from the day you start the contract, and a later renewal of that same
subscription does not start them again.
Where a statute counts days "from" or "after" a date, that date itself does not count, and the period ends at the end
of the last day. A purchase on 1 November with a 14-day period can be withdrawn through the end of 15 November. A
7-calendar-day period from that purchase runs through the end of 8 November. Business days skip weekends and the
public holidays of that country.
European Union and EEA
Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece,
Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, the Netherlands, Norway,
Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden. Directive 2011/83/EU, Articles 9, 10, 14, and
16.
Period. 14 days after the day you enter the contract.
Refund. The charges taken for that contract, minus a proportionate amount for
days of access already provided, and only if you expressly asked us to start during the withdrawal period. If you
did not make that request, the full charge. See section 3.
United Kingdom
England, Wales, Scotland, and Northern Ireland. Consumer Contracts (Information, Cancellation and Additional
Charges) Regulations 2013, regulations 29 to 31 and 36.
Period. The same 14 days as the European Union, counted the same way.
Refund. The same amount as the European Union. An ongoing subscription is not
fully performed during those 14 days, so the right lasts the full 14 days.
Brazil
Consumer Defense Code, Law 8.078/1990, Article 49.
Period. 7 calendar days from the day you contract or the day the service is
delivered, whichever is later. For access or credits delivered immediately, that is 7 calendar days from the
purchase.
Refund. The full amount paid for that purchase, with the monetary correction
Article 49 requires. This right cannot be waived. It covers the subscription and a credit top-up or auto-recharge
inside the 7 days, including credits already used.
Argentina
Consumer Protection Law 24.240, Articles 32 to 34.
Period. 10 calendar days from delivery of the good or from the contract,
whichever is later. For this Service, that is 10 calendar days from the purchase. This right cannot be waived.
Refund. The full amount paid for that purchase, including a credit top-up
already used.
Costa Rica
Consumer Protection Law, Law 7472, for distance sales including internet sales covered by that law, and Article
130 of its regulation.
Period. 8 business days after the sale is completed. Send a written notice
(email is enough) within that period.
Refund. The full amount paid for that purchase.
South Korea
Act on the Consumer Protection in Electronic Commerce, Article 17.
Period. 7 days from the day supply begins.
Refund. The unused portion of a divisible subscription or unused credits. The
part already supplied is kept, because supply has started and this page states that limit where you can read it
before you pay. If we failed to make that limit visible before you paid, the used part is refundable too.
Taiwan
Consumer Protection Act, Article 19.
Period. 7 days from the day access starts, for an ongoing Plus subscription.
Refund. The full subscription charge. A month or a year of access is not an
online service that is fully performed the moment it begins, so the statutory exception does not remove this
right.
Taiwan credit top-ups. A credit top-up or auto-recharge that is delivered in full
to your balance at purchase is digital content supplied with your consent after the notice in this section. The 7-day
right does not apply to that credit purchase once the credits are in your account. If this notice was not available
to you before you paid, the 7-day right applies to that credit purchase and we refund the amount paid.
If we never told you about the EU or UK right. If we did not give you the
required information about the withdrawal right before you contracted, the 14 days are extended. The extension ends
12 months after the original 14 days would have ended. If we give you the information during those 12 months, a new
14 days starts on the day you receive it. Directive 2011/83/EU, Article 10, and regulation 31 of the UK 2013
Regulations.
A Plus subscription is an ongoing digital service. Starting it does not cancel the EU or UK 14-day right. The
exception for a one-off download of digital content does not apply. The right ends when the 14 days end, or earlier
only if the whole paid period has already been fully performed, which it has not been during those 14 days.
3. How the EU and UK amount is calculated
If, before you paid, you expressly asked us to start access during the withdrawal period, the amount we keep is:
price of that charge × (days you had access ÷ days that charge covered)
We refund the rest, rounded to the cent. Each day you had access counts, including the day access started. The day
you withdraw counts if you still had access that day. If you withdraw before access starts, days of access are zero
and we refund the full charge.
If you did not expressly ask us to start during the withdrawal period, we refund the full charge. Directive
2011/83/EU, Article 14(3) and 14(4), and the matching UK rules.
- $1 trial, withdrawn on day 7, where the $1 covers 14 days and you asked us to
start immediately: we keep $0.50 and refund $0.50. The later Plus charge is cancelled if it has not been taken, and
refunded in full if the withdrawal is still in time and that charge was taken.
- $200 monthly charge, withdrawn on day 10 of a 30-day period, where you asked us
to start immediately: we keep $66.67 and refund $133.33.
- $2,000 yearly charge, withdrawn on day 10 of a 365-day period, where you asked
us to start immediately: we keep $54.79 and refund $1,945.21.
The same formula is the "unused portion" for South Korea: we refund the price minus the portion of the period
already supplied.
For an Agent credit purchase by an EU or UK consumer, the same rule applies to that purchase. Credits already spent
on a live fill are access already provided. Unused credits are refunded. If you did not expressly ask for immediate
delivery, the full top-up or auto-recharge is refunded.
4. Countries with no change-of-mind refund for this Service
If your country is not in section 2, we do not refund because you changed your mind. In particular:
- United States. There is no federal change-of-mind refund for an online purchase
you started. The FTC Cooling-Off Rule (3 business days) applies to sales at your home or a temporary location, not
to an order you placed online. Some states require a refund of an automatic renewal if the renewal terms, consent,
or cancellation method were not presented as that state's law requires. We refund the renewal charges that statute
covers. That is a refund of a non-compliant renewal, not a refund of a first charge you regret.
- Canada. There is no general change-of-mind refund for an online purchase. In
Quebec, you can cancel if mandatory information was missing or we did not send a copy of the contract: 7 days after
you receive the copy, or 30 days after the contract if we did not send a copy within 15 days. Some other provinces
have a similar cancellation right when required internet-contract disclosures were not given. When the information
was provided, those rights do not arise.
- Australia and New Zealand. There is no general cooling-off period for an online
digital subscription. A refund is a remedy for a failure of a consumer guarantee, under section 5, not a
change-of-mind right.
- Chile. Law 19.496, Article 3 bis, lets us exclude the 10-day retraction right for a
service when we say so before you pay. We exclude it. That right does not apply to a Breakflare subscription or to
Agent credits.
- Switzerland, Japan, India, and Singapore. An online digital service you chose
to buy, with these terms displayed, has no general statutory change-of-mind refund. Japan's specified-commercial-transaction
cooling-off rules do not apply to an online purchase you initiated when the terms are displayed, as they are on
this page.
- Vietnam. The Law on Protection of Consumers' Rights 2023 (Law 19/2023/QH15)
does not give a general cooling-off period. If we gave inaccurate or incomplete mandatory pre-contract information,
you may terminate within 30 days of the contract and we refund the unused portion within 30 days (Article 38). A
plan of three months or more is a continuous supply of services. Article 42 lets you terminate that contract at any
time and pay only for the part used, unless the parties agreed otherwise. This policy is that agreement:
cancellation stops the next renewal, and the current period stays paid.
- Peru. There is no general right to return an online purchase because you changed
your mind. If the sale used an aggressive or misleading practice listed in Article 58 of the Consumer Protection
and Defense Code, Article 59 lets you demand restitution within 7 calendar days of the contract, receipt, or start
of the service, whichever is later. You have to prove that practice.
5. Not supplied, or not as described
If the Service is not supplied, or is not as described, consumer law can require a fix or a refund of the affected
charge. That is a remedy for a failure. It is a different right from the change-of-mind periods in section 2, and it
has no single worldwide number of days.
- EU and EEA. Directive (EU) 2019/770. For a subscription, we are answerable for a
lack of conformity for the whole period we supply it. You can require us to bring the Service into conformity. If
we cannot, or we fail to, or the failure is not minor, you can end the contract. We then refund the price for the
period that was not in conformity.
- United Kingdom. Consumer Rights Act 2015. Digital content must be of
satisfactory quality, fit for a particular purpose you made known, and as described. The remedy is repair or
replacement, then a reduction in price, which can be the full price of the affected charge.
- Australia. Australian Consumer Law. Services must be provided with due care and
skill, be fit for a purpose you made known, and be supplied within a reasonable time. A major failure lets you
choose a refund of the affected charge. There is no fixed cooling-off period. For a subscription, the guarantee
runs for the period you paid for.
- New Zealand. Consumer Guarantees Act 1993. A substantial failure of a guarantee
lets you cancel and obtain a refund of the affected amount.
- South Korea. If what was supplied differs from what was indicated, advertised,
or contracted, Article 17(3) of the Electronic Commerce Act lets you cancel within 3 months of supply, or within 30
days of the day you knew or could have known, and we refund the affected amount.
A losing trade, a coin that did not break out, or a result that differed from your expectation is not a failure of
description. Breakflare is research and tooling. It is not a promise of profit.
6. Billing errors
We reverse a charge that was not owed. That includes a duplicate charge, a charge taken after a cancellation that
had already stopped renewal, and an Agent credit top-up, auto-recharge, or debit that our records show was applied
by a Breakflare system error. We refund or re-credit the amount that was not owed. A trading loss on your own
exchange, including futures margin, funding, and liquidation, is not a billing error.
7. Trial, cancellation, and Agent credits
$1 Plus trial
Plus monthly and yearly subscriptions start with a $1, 14-day trial of the full Plus product. The $1 is charged when
you start, and access starts then. Core is free and has no trial.
The product trial and a statutory withdrawal period are different clocks. They can cover similar dates. Cancelling
before the trial ends stops the Plus charge of $200/month or $2,000/year. The $1 stays charged unless section 2, 5,
or 6 requires it back.
Cancellation
Cancel in the billing controls on https://app.breakflare.com, or by email to legal@breakflare.com from the address on your account. You keep access
through the end of the paid period, or through the end of the trial if you cancel before the subscription charge.
A cancellation we receive inside a section 2 period is also a withdrawal for that period. You do not have to give a
reason, and you do not have to use a special phrase. To have a dated record, email us as well. Use the note in
section 8.
Agent credits
Paper mode is included and never debits credits. Live trading is optional. Credits pay Agent live-usage fees only.
They are not cash, they earn no interest, and they are not a deposit. Breakflare does not hold your exchange
balances.
Credit top-ups and auto-recharges stay charged, including any unused balance, except under section 2, 5, or 6. Each
top-up and each auto-recharge is its own purchase. Its statutory period, if any, starts on the day of that charge.
Cancelling Core, Plus, or Enterprise does not return a remaining credit balance.
- Fills. The usage fee debited when the Agent executes a live order stays
charged. Plus, including the trial, is 0.5% of notional on the open and 0.5% on the close. Core is 1% on the open
and 1% on the close. Enterprise is the rate in your agreement, or 0.5% per side until that rate is on file. The
same credit rate applies to a Plus USD-M futures fill. Exchange fees are separate.
- Inside a section 2 window. Brazil, Argentina, and Costa Rica: we refund the
amount paid for that credit purchase even if some credits were used. EU, EEA, and UK: section 3. South Korea: the
unused credits only. Taiwan: section 2, credit top-ups.
8. How to ask, and when we pay
Email legal@breakflare.com with the subject line "Refund request"
before the period ends. You can copy this:
To Bond Solutions, s.r.o. (legal@breakflare.com):
I withdraw from my contract for Breakflare.
What I bought:
Date of purchase:
Amount charged:
Account email:
Name:
Country where I live:
Date of this notice:
A statutory withdrawal needs a clear statement and a date inside the period. It does not need a reason. A billing-error
or "not as described" request should include what went wrong.
We reply within a few business days. Approved refunds go back to the original payment method through Stripe.
- EU, EEA, and UK: we send the refund within 14 days of your withdrawal.
- Brazil: immediately, as Article 49 requires.
- South Korea: within 3 business days of a valid cancellation.
- Taiwan: within 15 days of the day after we receive a valid notice.
- Argentina, Costa Rica, and billing errors: without delay, and in any event within 14 days of a valid request.
Your bank or card issuer decides when the credit appears on your statement.
A chargeback opened before you email us can lead to suspension of the account while the dispute is open. A statutory
withdrawal emailed inside the period is the request we act on.
9. Closed accounts
If we suspend or close your account for a breach of the Terms, abuse, fraud, or a security risk, fees already paid
stay paid. A section 2 right that cannot be waived, a section 5 remedy, and a section 6 billing error still apply.
10. Changes
We may update this Refund Policy. The new date appears at the top of this page. The version in effect at the time of
a purchase governs that purchase, except where the law applies a later mandatory rule.
